Appearing by videoconference from Kigali and from within France, several witnesses alternately accused and defended the former driver, leaving judges and jurors to confront a central question: was he a willing participant in the 1994 Genocide against the Tutsi, or a man trying to survive within a violent system?<\/em><\/strong><\/p>\n\n\n\n<p>The hearing formed part of the sixth day of proceedings and focused largely on testimony from Rwanda, where witnesses connected to events in the former Kibuye prefecture described how vehicles and drivers were used during attacks on Tutsi civilians. The prosecution alleges that Muhayimana, who worked as a driver for a fishing project and later for a guesthouse, transported Interahamwe militia and others to massacre sites, including in the Bisesero area. He denies taking part in the killings.<\/p>\n\n\n\n<p>One witness, a former colleague of the accused who appeared from Kigali, showed the court the consequences of the violence he survived. Speaking through an interpreter, he raised his amputated arm before the camera, explaining that he had been shot during the attacks in 1994. He told the court he had known the accused through work and described seeing vehicles linked to their workplace, including a blue Daihatsu and a red pickup, used during the violence. According to his account, the accused drove militia members toward areas where Tutsi were being hunted, including the hills around Karongi and Bisesero, and later returned to town.<\/p>\n\n\n\n<p>His testimony, however, also reflected the complexities that have marked the trial. He acknowledged that he himself had been arrested after the genocide on suspicion of complicity and detained for years before being released without conviction. Under questioning from the presiding judge, some elements of his recollection shifted, particularly about whether he personally witnessed certain events or learned of them from others. Even so, he maintained that his core account was truthful.<\/p>\n\n\n\n<p>Another witness testified from prison in Rwanda, where he is serving a life sentence for his own role in the violence. In contrast to the previous testimony, he spoke in defense of the accused. He described the driver as someone who had maintained good relations with Tutsi neighbors and suggested that he had at times tried to help people escape. He also claimed that the accused had been threatened by extremists and forced to pay money to avoid being killed, portraying him as someone navigating danger rather than directing it.<\/p>\n\n\n\n<p>Yet this testimony quickly became entangled in contradictions. The court read excerpts from earlier statements in which the same witness had placed the accused behind the wheel of vehicles transporting militia to attack sites. Confronted with those records, he acknowledged having made false declarations in the past, explaining that detainees sometimes hoped cooperation might improve their circumstances. He now insisted that the accused had not participated in killings and had even been ill for part of the period under discussion.<\/p>\n\n\n\n<p>Further testimony added to the uncertainty. Another convicted participant in the violence told the court that he and the accused had been present in areas where attacks occurred, including near the Gatwaro stadium and a nearby religious site. In previous statements, he had described seeing the accused driving vehicles carrying militia and gendarmes toward Bisesero. During the hearing, however, he alternated between confirming and qualifying those claims, at times acknowledging that some details were based on what he had heard rather than personally seen. He also noted that vehicles were frequently requisitioned and that drivers were often ordered to transport attackers, raising the question of whether such actions were voluntary or coerced.<\/p>\n\n\n\n<p>A further witness offered testimony largely supporting the prosecution, saying he saw the accused driving a vehicle used to transport militia toward the hills of Bisesero, where thousands of Tutsi were killed after weeks of resistance. He recalled encountering the driver after he had dropped off attackers and said he did not appear to be under immediate threat at the time. He also told the court that while many drivers were asked to transport militia, not all accepted, suggesting that participation could not always be explained by coercion alone.<\/p>\n\n\n\n<p>Throughout the hearing, lawyers for both sides focused on inconsistencies between current testimony and earlier statements. Defense counsel pointed to contradictions and the passage of time, arguing that memories formed under traumatic conditions and revisited decades later may have shifted. Prosecutors emphasized recurring elements across multiple accounts: the presence of vehicles, the transport of armed groups, and the accused\u2019s role as a driver during the months of violence.<\/p>\n\n\n\n<p>The case forms part of a broader effort by French courts to prosecute genocide suspects living in France, often decades after the events of 1994. Such trials rely heavily on witness testimony gathered long after the genocide, with many participants appearing by videoconference from Rwanda. The distance in time and place, combined with trauma and the erosion of memory, can make establishing a clear narrative challenging.<\/p>\n\n\n\n<p>By the close of the session, no simple picture had emerged. One witness displayed the physical scars of the genocide while accusing the driver of aiding attackers. Another, convicted of participating in the violence, defended him while acknowledging past falsehoods. Others placed him at the wheel of vehicles heading toward massacre sites but differed on whether he acted freely or under pressure.<\/p>\n\n\n\n<p>As the appeal proceedings continue, the court must weigh these competing accounts to determine what responsibility, if any, the accused bears. The task underscores the broader challenge of trying genocide cases decades later: justice often depends not only on documents and physical evidence, but on human memory, fragile, contested and shaped by time.<\/p>\n\n\n\n<p>The question at the heart of the trial remains unresolved. In the chaos of 1994, was the driver simply trying to survive, or did he help carry others to their deaths?
